KeyCite citing references for a statute may include cases that do not cite to the statute itself

July 3, 2009

There are two portions of the Citing References display. The “Citations from USCA” lists all of the cases which are included in the notes of decisions, whether or not those cases cite to the statute. Our editors occasionally include cases in notes of decision that portray common law as it existed before the statute was enacted. They will also decide to carry over notes of decision from prior statutes when they have been renumbered.

By contrast, everything in the second portion of KeyCite Citing References, (a.k.a. the “Citing Cases” portion) will specifically cite to the statute.
