December 27, 2010

West's Key 227 Judges
West's Key 227I Appointment, Qualification, and Tenure
West's Key 227k11 Removal or Discipline
West's Key 227k11(2) k. Standards, Canons, or Codes of Conduct, in General.

Court of Common Pleas judge’s statements in burglary and assault case over which he was presiding that he was “checking defendant into the boards,” would not let defendant out of jail to go smoke crack again, and would personally see to it that anyone involved in obstruction of justice would be indicted, convicted, and given the maximum sentence violated Rule of Professional Conduct which prohibited attorneys from engaging in conduct that was prejudicial to the administration of justice; blurring of judicial role and lack of neutrality were prejudicial to the administration of justice.
Disciplinary Counsel v. Gaul, 936 N.E.2d 28 (Ohio 2010)
