ELIGIBILITY: The WestlawNext Mobile Photo Promotion (“Promotion”) is open only to residents of the 50 United States or the District of Columbia who are employed by a corporation, nonprofit organization, or academic institution, with a legal or regulatory title. Employees, officers, directors of West, a Thomson Reuters business, Gage Marketing Group, LLC, their respective parent companies, affiliates, subsidiaries, advertising/ promotional agencies and the members of their immediate family (parents, siblings, children & spouse) regardless of where they live or those persons living in the same household of such employees/officers/directors, whether related or not, are ineligible. Employees of LexisNexis are also not eligible. Not open to the general public. Void where prohibited by law.

HOW IT WORKS: Take a digital photo of a unique location where you use WestlawNext Mobile. A screen shot from the WestlawNext Mobile website should clearly be visible in the photo. You may include yourself in the photo, but don’t include other people unless you have written permission from each person to submit the photo with their image in this Promotion. Photo must be in color, in GIF, JPG or BMP format and cannot exceed 2MB.

Beginning on 5/01/10 at 12:00:01 AM (CDT) through 7/9/10 at 11:59:59 PM (CDT) email your photo to westelearning@thomsonreuters.com. Include in the body of your email your name, title, daytime phone number, email address and the name and address of your employer. You must also include a brief caption to accompany the photo submitted. The photo and caption are collectively referred to herein as an “Entry.”  Any other attempted form of entry is prohibited.  Limit one (1) photo per submission. You may enter as often as you wish provided each Entry is unique. All Entries will be entered into the weekly random drawing for the week the Entry is received as defined below.

Unintelligible or incomplete Entries will be disqualified.  Sponsor is not responsible for lost, late, misdirected Entries or Entries not received by the entry deadlines. Entries become the exclusive property of Sponsor and will not be returned.  Entries must be suitable for publication in a public forum (as determined by Sponsor in its sole discretion).  Entries may not be obscene or indecent, and may not include nudity, pornography or profanity; may not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); may not include threats to any person, place, business, group or world peace; may not invade privacy or other rights of any person, firm or entity; may not defame, disparage or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights; may not reflect negatively on the Sponsor or its products; and may not depict any drugs or unlawful, immoral or dangerous act or suggest that any individual should undertake any such act.

CONDITIONS OF ENTRY: As conditions of Entry into this Promotion, Entrant warrants and represents that Entry is (a) original and has been legally created; (b) does not infringe on the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; (c) has not been entered in or won previous contests or awards; (d) has not been published or distributed previously in any media; and (e) use thereof does not infringe third party rights (including those of any photographer).  Entrant represents that he/she owns or has procured all necessary rights in the Entry to grant Sponsor the rights granted herein.  By submitting an Entry, Entrant irrevocably grants Sponsor, the unconditional and perpetual right and permission to reproduce, store, copy, publish, post, display, edit and/or otherwise use or reuse (without limitation as to when or to the number of times used) the Entry as submitted or as edited/modified in any way by the Sponsor in its sole discretion, as well as to use Entrant’s name, likeness, photograph (collectively, “Likeness”), and/or statements regarding his/her participation in this Promotion (with or without using the Entrant’s name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party.  Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor’s use of the Entry, and agrees not to sue or assert any claim against the Sponsor for the use of the Entry or Entrant’s Likeness or statements.

WEEKLY RANDOM DRAWINGS: One (1) potential winner will be selected in each weekly drawing, as indicated in the chart below, from among all eligible Entries received by the entry deadline for each drawing. Non-winning Entries will be carried over into subsequent drawings. Decisions of the judges are final. Odds of winning will depend upon the number of eligible Entries received by the entry deadline for each drawing. Limit one (1) prize per person. Potential winners will be notified by email, phone or mail. Being selected as a weekly random drawing winner has no bearing on being a judged finalist.

JUDGING/PUBLIC VOTING: At the end of the promotion, the Sponsor will judge all entries based on the following criteria:

  • (50%) Creativity of Location
  • (30%) Prominence of WestlawNext Mobile in photograph
  • (20%) Quality of Photo

The 3 highest scoring Entries will be posted on the Westlaw Insider Blog (staging.blog.legalsolutions.thomsonreuters.com) for the public (ages 18 or older) to vote for their favorite Entry. Limit one (1) vote per person per day. At the close of the Voting Period, the Entrant whose Entry receives the most votes will win an iPod touch. In the event that the public voting results in a tie, the Entry with the highest score from the initial round of judging will be declared the winning Entry. Decisions of the judges are final. Potential winners will be notified by email, phone or mail.

PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): Eight (8) Weekly Prizes (one per week) and one (1) Public Voting Prize: an iPod touch. ARV: $199 each. In the event of unavailability of stated prize, Sponsor reserves the right to substitute items of equal or greater value.  Prizes are not transferable, exchangeable, or redeemable for cash.  iPod and touch are trademarks of Apple, Inc.  Apple, Inc. is not a sponsor of or affiliated with this Promotion.

Reporting and payment of any federal, state, local, or other taxes, fees, insurance, or other amounts owed in connection with any prize are the sole responsibility of the winners. EACH PRIZE IS GIVEN AWAY BY SPONSOR “AS-IS.”  SPONSOR DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ANY PRIZE, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

CONDITIONS OF PARTICIPATION: Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Promotion should a virus, bug, unauthorized human intervention or other cause beyond the control of Sponsor, corrupt or impair the administration, security, fairness, or proper play of the Promotion. In such event, winners will be selected from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor. Notice of such action by Sponsor will be posted on Westlaw Insider.

GENERAL TERMS: Any person who attempts to participate under multiple identities or uses any device or artifice to enter multiple times in violation of these Official Rules will be disqualified. Neither Westlaw nor any of its agencies are responsible for late, lost, illegible, incomplete, damaged or misdirected entries; lost, interrupted or unavailable network, server or other connections, miscommunications, computer hardware or software malfunctions or other technical failures of any kind, ISP/network/website accessibility or availability, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information regardless of cause; appointment and schedule difficulties; Sponsor is also not responsible for incorrect or incomplete Promotion information, whether due to electronic, mechanical or other errors, unauthorized access to the website or other cause. Use of robotic, automated, programmed or like means to enter the Promotion multiple times in violation of the above-indicated entry limitation will void all entries affected by such methods. Sponsor reserves the right, in its sole discretion; to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or website; or who is in violation of the terms of use of the website as set forth in the West privacy policy. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

By participating, entrants release and agree to hold harmless West, a Thomson Reuters business, Gage Marketing Group, LLC, their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors, shareholders and agents of any of the above organizations from any and all liability for any injuries, losses or damages to person (including death) and/or property of any kind caused in whole or in part, directly or indirectly, by participation in the Promotion or the acceptance, possession or use/misuse of  prize. Where legal, by accepting prize, winner agrees to the use of winner’s name and address (city, state), likeness, photograph and/or voice as well as any statements made by winner regarding the Promotion or Sponsor (provided they are true) for advertising/publicity/trade purposes, without notice or further compensation.
