ELIGIBILITY: The WestlawNext Mobile Blog Contest (“Contest”) is open only to residents of the 50 United States or the District of Columbia who are employed by a corporation, nonprofit organization, or academic institution, with a legal or regulatory title and who are subscribers of WestlawNext Mobile as of 5/10/10. Employees, officers, directors of West, a Thomson Reuters business, Gage Marketing Group, LLC, their respective parent companies, affiliates, subsidiaries, advertising/ promotional agencies and the members of their immediate family (parents, siblings, children & spouse) regardless of where they live or those persons living in the same household of such employees/officers/directors, whether related or not, are ineligible. Employees of LexisNexis are also not eligible. Not open to the general public. Void where prohibited by law.
HOW IT WORKS: Beginning on 5/10/10 at 12:00:01 AM (CDT) through 6/11/10 at 11:59:59 PM (CDT) go to www.surveymonkey.com/s/westlawnextmobile and submit an essay of 300 words or less describing the benefits of using WestlawNext Mobile (specifically how it helps you). Include your name, title, daytime phone number, email address and the name and address of your employer. Any other attempted form of entry is prohibited. Limit one (1) entry per person.
Essays must be written in English. Essays that do not fully comply with the requirements set forth herein may be disqualified. Essays that contain more than 300 words may be disqualified at the Sponsor’s sole discretion. Essays may not include profanities and may not depict the Sponsor unfavorably. Essays must be suitable for publication in a public forum (as determined by Sponsor in its sole discretion). Essays must not infringe any third-party rights, and must be suitable for publication. Essay cannot defame or invade publicity rights or the privacy of any person, living or deceased, or otherwise infringe on any person’s personal or proprietary rights, Entrant may be required to sign an Affidavit certifying that essay is his/her her own original work, that they hold all rights to the submission, that the submission has not been previously reproduced/published or won a previous prize or award. Unintelligible or incomplete entries will be disqualified. Sponsor is not responsible for lost, late, misdirected entries or entries not received by the entry deadline. Entries become the exclusive property of Sponsor and will not be returned.
CONDITIONS OF ENTRY: As conditions of Entry into this Contest, Entrant warrants and represents that Entry is (a) original and has been legally created; (b) does not infringe on the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; (c) has not been entered in or won previous contests or awards; (d) has not been published or distributed previously in any media; and (e) use thereof does not infringe third party rights. By entering, Entrant irrevocably grants Sponsor, the unconditional and perpetual right and permission to reproduce, store, copy, publish, post, display, edit and/or otherwise use or reuse (without limitation as to when or to the number of times used) the Entrant’s Essay as submitted or as edited/modified in any way by the Sponsor in its sole discretion, as well as to use Entrant’s name, likeness, photograph (collectively, “Likeness”), and/or statements regarding his/her participation in this Contest (with or without using the Entrant’s name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor’s use of the Entry, and agrees not to sue or assert any claim against the Sponsor for the use of the Entry or Entrant’s Likeness or statements.
JUDGING: All eligible entries will be judged based on the following criteria:
- (50%) Clearly articulates the benefits of WestlawNext Mobile
- (25%) Tone of writing is consistent with the tone of WestlawNext Mobile
- (25%) Entry tells a story
The highest scoring entry will be posted on the Westlaw Insider Blog and will be named the Grand Prize winner. In the event of a tie, the entry with the highest score for “Clearly articulates the benefits of WestlawNext Mobile” will be deemed the winner. Decisions of the judges are final. Potential winner will be notified by email, phone or mail.
PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): One (1) Prize: an iPod touch. ARV: $199. In the event of unavailability of stated prize, Sponsor reserves the right to substitute items of equal or greater value. Prize is not transferable, exchangeable, or redeemable for cash. iPod and touch are trademarks of Apple, Inc. Apple, Inc. is not a sponsor of or affiliated with this Promotion.
Reporting and payment of any federal, state, local, or other taxes, fees, insurance, or other amounts owed in connection with any prize are the sole responsibility of the winners. PRIZE IS GIVEN AWAY BY SPONSOR “AS-IS.” SPONSOR DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ANY PRIZE, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
CONDITIONS OF PARTICIPATION: Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Contest should a virus, bug, unauthorized human intervention or other cause beyond the control of Sponsor, corrupt or impair the administration, security, fairness, or proper play of the Contest. In such event, all entries received prior to termination will be judged and winner selected from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor. Notice of such action by Sponsor will be posted on Westlaw Insider.
By participating, entrants release and agree to hold harmless West, a Thomson Reuters business, Gage Marketing Group, LLC, their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors, shareholders and agents of any of the above organizations from any and all liability for any injuries, losses or damages to person (including death) and/or property of any kind caused in whole or in part, directly or indirectly, by participation in the Contest or the acceptance, possession or use/misuse of prize. Where legal, by accepting prize, winner agrees to the use of winner’s name and address (city, state), likeness, photograph and/or voice as well as any statements made by winner regarding the Contest or Sponsor (provided they are true) for advertising/publicity/trade purposes, without notice or further compensation.
