Texas Governor Rick Perry Orders State Agencies and Contractors to Verify Employment Eligibility of All Current and Prospective Employees
On December 3, 2014, Texas Governor Rick Perry issued an Executive Order (RP 80) in which he directs all agencies under the direction of the governor to: (1) verify the employment eligibility of all current and prospective agency employees through the federal E-Verify system and (2) include, as a condition of all state contracts for services, a requirement that contractors utilize the E-Verify system to determine the eligibility of all persons employed during the contract term to perform duties within Texas, and all persons (including subcontractors) assigned by the contractor to perform work pursuant to the contract. Agencies not under the direction of the governor are encouraged to verify the employment eligibility of their current and prospective employees utilizing the E-Verify system and to require contractors to utilize the E-Verify system to verify the employment eligibility of their employees and subcontractors. The order was effective immediately and supersedes all previous orders inconsistent with its terms.
E-Verify is a free, Internet-based employment verification system operated by U.S. Citizenship and Immigration Services in partnership with the Social Security Administration that allows participating employers to electronically verify the employment eligibility of their newly hired employees.
