92 Constitutional LawUnder the Noerr-Pennington doctrine, which grants immunity to those who petition any department of the government for redress, the sham exception for intentional fraud on a court cannot lightly be taken to apply in a legislative context, because the political arena has a higher tolerance for outright lies than the judicial arena does.
