35 ArrestCapital defendant’s right to counsel was not impaired by bailiff’s audible snoring during counsel’s argument at close of penalty phase, or by trial court’s refusal to permit rereading of defense counsel’s argument, where counsel was not prevented from arguing and jury was not restrained from listening.
