Even if there was a nexus between the state and baseball league, a girl seeking preliminary injunction to allow her to play in boys’ baseball league as opposed to girls’ softball league failed to allege or prove that the league’s allegedly discriminatory act of requiring her to play in the girls’ softball league had been compelled by the state and absent such an allegation or proof, it was unlikely that the girl would succeed on the merits of civil rights claim; thus, preliminary injunction would not issue.
