08-21-14Assertions by helicopter owner and pilot that there was no evidence that pilot trespassed on house resident’s property because resident had no legal claim for a trespass of the super-adjacent airspace about her real property at the altitude maintained by pilot sufficiently stated element for which there was no evidence, so as to satisfy requirements for no-evidence motion for summary judgment on resident’s trespass claim, which arose out of incident in which helicopter hovered over resident’s house while obtaining aerial footage for news story.
